§ 22-131. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Contractor.
(1)
The term "contractor" means any person engaged in the business of constructing, altering, repairing, or demolishing buildings, structures, utilities, site improvements or topography, including, but not limited to:
a.
General building contractors;
b.
Cement or concrete contractors;
c.
Masonry contractors;
d.
Carpentry contractors;
e.
Electrical contractors;
f.
Plumbing contractors;
g.
Roofing contractors;
h.
Drywall contractors;
i.
Excavating contractors;
j.
Fencing contractors;
k.
Garage contractors;
l.
Glazing contractors;
m.
Heating, air conditioning, and ventilating contractors;
n.
Plastering contractors;
o.
Porch and deck contractors;
p.
Sewer and drainage contractors;
q.
Guttering and window contractors;
r.
Wrecking contractors;
s.
Blacktop sealing contractors;
t.
Swimming pool contractors;
u.
Insulation contractors;
v.
Water and dampproofing contractors; and
w.
Siding contractors.
(2)
The term "contractor" does not include any person performing as a contractor solely for or on behalf of a governmental entity.
(3)
An owner of property performing work on property that the owner will occupy or has occupied continuously for a period of at least six months shall not be considered a contractor as set forth in this article. However, any person hired by such owner to perform work on such property shall be considered a contractor.
(4)
Any person performing work on a residential repair project costing less than $3,000.00 for all labor and materials for such project shall not be considered a contractor for that project; provided, however, any person providing blacktop or asphalt sealing services shall be considered a contractor for any project equal to or exceeding $200.00 for all labor and materials.
Person means any person or individual, partnership, firm, association, corporation, trust or other legal entity.
