§ 38-92. Fines.

  • (a)

    An alarm user and monitoring company shall be fined, based on each calendar year, as follows:

    The schedule of fines shall be applied as an administrative function of the police and are payable to the city on demand. A fine notice will be mailed to the alarm user or alarm installation or monitoring company as identified in the fine schedule.

    (b)

    If cancellation occurs prior to law enforcement arriving at the scene, this is not a false alarm for the purpose of fines, and no fines will be assessed.

    (c)

    The alarm installation company shall be assessed a fine if the officer responding to the false alarm determines that an on-site employee of the alarm installation company directly caused the false alarm. In this situation, the false alarm will not be counted against the alarm user.

    (d)

    The alarm installation company shall be issued a fine if the police determines that an alarm installation company employee knowingly made a false statement concerning the inspection of an alarm site or the performance of an alarm system.

    (e)

    Notice of the right of appeal under this article will be included with any fines. The chief of police shall have the authority to waive any fines imposed hereunder when there are extenuating circumstances such as, but not limited to, very severe weather conditions, acts of God, or disasters.

    (f)

    There shall be no fines under this section imposed upon any of the following:

    (1)

    Any federal, state, or local governmental entity;

    (2)

    Any not-for-profit organization, association, or corporation; or

    (3)

    Any private resident for a false alarm occurring at a private residence.
